Terms and Conditions

Please read these Terms and Conditions carefully before using the Atlas Market Exchange platform, website, or any of our services. By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.

These Terms and Conditions govern the relationship between Atlas Market Exchange (referred to as "we", "us", or "the Company") and you (referred to as "you", "the Client", or "the User"). Atlas Market Exchange is a fully licensed Danish bank operating under the supervision of the Danish Financial Supervisory Authority (FSA).

1. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • "Platform" refers to the Atlas Market Exchange website, trading interface, mobile application, and all associated digital tools and services.
  • "Account" refers to the trading or investment account opened by the Client with Atlas Market Exchange.
  • "Financial Instruments" refers to all tradable assets available on the Platform, including but not limited to stocks, ETFs, forex, cryptocurrencies, CFDs, and mutual funds.
  • "Order" refers to any instruction submitted by the Client to buy, sell, or otherwise transact in a Financial Instrument.
  • "Applicable Law" refers to all laws, regulations, directives, and guidelines applicable to the Company and its operations, including those of the Danish Financial Supervisory Authority (FSA) and relevant European Union financial regulations.

2. Eligibility and Account Registration

To open an account and use our services, you must meet all of the following eligibility requirements:

  • You must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.
  • You must be a resident of a country in which Atlas Market Exchange is permitted to offer its services.
  • You must not be subject to any legal restriction or prohibition that prevents you from entering into financial transactions.
  • You must provide accurate, complete, and up-to-date information during the account registration process.
  • You must pass all required identity verification (KYC) and anti-money laundering (AML) checks as required by applicable law.

Atlas Market Exchange reserves the right to refuse account registration or suspend an existing account if any eligibility requirements are not met or if we have reasonable grounds to suspect fraudulent, abusive, or unlawful activity.

3. Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any two-factor authentication details. You agree to:

  • Not share your login credentials with any third party under any circumstances.
  • Notify Atlas Market Exchange immediately if you suspect any unauthorised access to your account.
  • Ensure that your account information remains accurate and up to date at all times.
  • Take all reasonable precautions to prevent unauthorised use of your account and devices.

Atlas Market Exchange will not be liable for any loss or damage arising from unauthorised access to your account resulting from your failure to maintain the security of your login credentials.

4. Services Offered

Atlas Market Exchange provides access to a range of financial products and investment services, including:

  • Stocks: Direct access to equities listed on 30+ global exchanges across North America, Europe, and Asia-Pacific.
  • ETFs: Access to exchange-traded funds across global markets with advanced screening and comparison tools.
  • Forex: Trading in currency pairs across spot, options, swaps, and forward contracts.
  • Cryptocurrencies: Access to a selection of leading digital assets traded on our secure platform.
  • CFDs: Contracts for Difference on indices, commodities, equities, currencies, and interest rates.
  • Mutual Funds: Access to over 18,300 professionally managed funds from leading global asset managers.

The availability of specific products and services may vary depending on your country of residence and applicable regulatory requirements. Atlas Market Exchange reserves the right to modify, suspend, or discontinue any service at any time with reasonable prior notice where required by law.

5. Orders and Execution

When you submit an Order through the Platform, you authorise Atlas Market Exchange to execute that Order on your behalf in accordance with our Order Execution Policy. You acknowledge and agree that:

  • Orders are executed at the best available price at the time of execution, subject to market conditions and liquidity.
  • Atlas Market Exchange does not guarantee execution at a specific price, particularly during periods of high market volatility or low liquidity.
  • All Orders are subject to applicable margin requirements, account balance, and regulatory limits.
  • Atlas Market Exchange reserves the right to reject, cancel, or modify any Order at its discretion if required to comply with applicable law or risk management policies.
  • You are responsible for all Orders placed from your account, whether placed by you or by any person acting with or without your authorisation.

6. Fees, Charges, and Costs

By using our services, you agree to pay all applicable fees and charges as set out in our current Fee Schedule, which is available on the Platform and may be updated from time to time. These may include:

  • Trading Commissions: Applicable to stock and ETF trades, starting from EUR 1 per order.
  • Currency Conversion Fees: A fee of 0.25% applies when trading in a currency other than your account's base currency.
  • Overnight Financing Charges: Applicable to leveraged positions, including CFDs and certain forex positions held overnight.
  • Inactivity Fees: May be applied to accounts that have not placed a transaction within a specified period, as outlined in the Fee Schedule.
  • Withdrawal Fees: Certain withdrawal methods may be subject to processing fees as detailed in the Fee Schedule.

All applicable fees and costs will be clearly disclosed prior to order execution. Atlas Market Exchange reserves the right to amend its fee structure with prior notice to clients in accordance with applicable regulations.

7. Risk Disclosure

Trading and investing in financial instruments involves a significant level of risk. You should carefully consider the following before using our services:

  • The value of investments can fall as well as rise, and you may receive back less than you originally invested.
  • Past performance is not a reliable indicator of future results.
  • Leveraged products such as CFDs and forex carry a higher risk of rapid loss due to the use of leverage. A significant proportion of retail investor accounts lose money when trading these products.
  • Cryptocurrency markets are highly volatile and largely unregulated in many jurisdictions, which increases the risk of significant financial loss.
  • You should not invest money that you cannot afford to lose.
  • Atlas Market Exchange does not provide personalised investment advice. All investment decisions are made solely by you.

We strongly encourage you to seek independent financial advice before making any investment decisions, particularly if you are unfamiliar with the products or markets you intend to trade.

8. Client Money and Asset Protection

Atlas Market Exchange takes the protection of client assets seriously. In accordance with applicable regulations:

  • Client cash deposits are held in segregated bank accounts, separate from the Company's own funds, and are protected by the Danish Guarantee Fund up to EUR 100,000 per investor.
  • Securities held in custody on behalf of clients are also protected under the Danish Guarantee Fund framework, up to EUR 20,000 per client in the unlikely event of insolvency.
  • In the event of suspension of payments or compulsory winding-up, client securities would ordinarily be returned. If full restitution is not possible, the applicable guarantee fund coverage will apply.
  • Retail clients trading leveraged products under ESMA regulation benefit from negative balance protection, ensuring losses cannot exceed the total funds held in their account.

9. Prohibited Activities

You agree not to use the Platform or our services for any of the following purposes:

  • Engaging in market manipulation, insider trading, or any other activity that violates applicable financial regulations.
  • Using automated trading systems, bots, or algorithms that exploit system vulnerabilities or create an unfair advantage without prior written approval from Atlas Market Exchange.
  • Submitting false, misleading, or fraudulent information during account registration or at any other time.
  • Laundering money or financing any illegal, terrorist, or criminal activity.
  • Engaging in any activity that disrupts, damages, or interferes with the Platform's infrastructure, security, or normal operation.
  • Attempting to gain unauthorised access to any part of the Platform, other user accounts, or our systems.

Any violation of these prohibitions may result in the immediate suspension or termination of your account, and may be reported to the relevant regulatory or law enforcement authorities.

10. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, data, software, and design elements, is the property of Atlas Market Exchange or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your personal or internal business purposes. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Platform without prior written consent from Atlas Market Exchange.

11. Privacy and Data Protection

Atlas Market Exchange is committed to protecting your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Our Privacy Policy, which is incorporated into these Terms and Conditions by reference, sets out how we collect, use, store, and protect your personal information.

By using our services, you consent to the collection and processing of your personal data as described in our Privacy Policy. You have the right to access, correct, and request the deletion of your personal data, subject to applicable legal and regulatory obligations.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Atlas Market Exchange shall not be liable for:

  • Any financial loss arising from your use of the Platform or trading decisions made using information available on the Platform.
  • Losses resulting from system downtime, technical failures, delays in execution, or connectivity issues beyond our reasonable control.
  • Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.
  • Losses resulting from force majeure events, including but not limited to natural disasters, war, regulatory changes, or extreme market conditions.

Nothing in these Terms and Conditions shall limit our liability for fraud, gross negligence, or any liability that cannot be excluded or limited under applicable law.

13. Termination and Account Closure

Either party may terminate the client relationship and close the account at any time, subject to the following conditions:

  • You may request to close your account at any time by contacting our client support team, provided that all open positions have been closed and there are no outstanding obligations.
  • Atlas Market Exchange reserves the right to suspend or terminate your account immediately if you breach these Terms and Conditions, engage in prohibited activities, or if required to do so by a regulatory authority.
  • Upon termination, any remaining client funds will be returned to you after deducting any outstanding fees, charges, or liabilities owed to the Company.
  • Termination does not affect any rights or obligations that have already arisen prior to the date of termination.

14. Amendments to These Terms

Atlas Market Exchange reserves the right to amend these Terms and Conditions at any time. Where changes are material, we will provide reasonable prior notice to clients through the Platform or via email. Your continued use of our services following any amendment constitutes your acceptance of the updated Terms and Conditions.

We recommend that you review these Terms and Conditions periodically to stay informed of any updates. The most current version will always be available on our website.

15. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Hongkong. Any disputes arising out of or in connection with these Terms and Conditions shall first be referred to Atlas Market Exchange's client complaints procedure, details of which are available on the Platform.

If a dispute cannot be resolved through our internal complaints procedure, it may be referred to the Danish Financial Complaints Board or another competent regulatory authority or court of jurisdiction in Hongkong.
